The NBA legend Testifies He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, admitted that his drive to win and status as a newcomer motivated his push for 23XI Racing to “challenge” Nascar over alleged violations of antitrust rules.

Financial Stakes and a Will to Win

The owner disclosed financial and corporate details of his racing venture, saying he invested $40m of his own funds into the Cup Series operation co-founded with partner Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar in its entirety. From my perspective, the sport required examination through a new lens.”

The Core Dispute: Charter Agreements and Contract Pressure

The heart of the case involves the expiration of a 2016 agreement where Nascar granted each team a franchise. This system mirrors other major leagues with independent franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan testified for about sixty minutes and left the court to a media frenzy, with fans and media clamoring for a view or a photo of the sports legend.

Leading the Legal Charge

Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to change a operating model Jordan said is breaking the law to keep two hands on the wheel.

For Jordan and and a fellow team representative, who preceded Jordan, are events from last September. She recounted a frantic and emotional six hours where the sanctioning body told teams they had to sign a charter agreement extension. This agreement spanned 112 pages outlining pay for chartered teams and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to decline to sign that extensive document and take the issue to court. The other 13 organizations signed the agreement.

The team owners approached Nascar about potential amendments or negotiations. Nascar wasn’t talking, according to his testimony.

The Ultimate Motivation: Victory

But in the end, the resistance against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Success.

“Denny convinced me getting a third driver improved our chances to win,” he said, noting that he purchased another franchise last year for $28 million amid the legal dispute. “So I dove in.”

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She said the pressure of the signature deadline didn’t sit well.

She said, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but CEO Jim France refused the appeal.

“Don’t do this to us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If I have 30, that’s the number.”
