US Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The case stems from a erroneous removal to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to face human smuggling charges, he was detained in federal detention.
In her decision, the judge pointed out that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Background of the Case
The legal proceedings involve conflicting claims. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in the state of Tennessee.
Conditions of Freedom
The court, who was overseeing his challenge to deportation in a federal court, ruled that he must now comply with the conditions of his release from custody in Tennessee. This order shifts his supervision to the Tennessee court.
This decision represents a notable development in a complicated legal battle featuring claims of wrongful detention and disputed gang associations.
